Kraster Terms of Service

1. Introduction and Acceptance

1.1 These Terms of Service (`Terms`) form a legally binding agreement between you (`you`, `User`) and Kraster Technology Solutions Limited, a company registered in the Hong Kong Special Administrative Region (`Kraster`, `we`, `us`, `our`). By using any Kraster product or service, including installation, access, or purchase, you confirm that you have read, understood, and agreed to these Terms and all policies referenced herein.

1.2 These Terms govern your use of the Kraster ecosystem, which includes: the Kraster Hardware Wallet (device and embedded firmware); the Kraster App (mobile and/or desktop); the Kraster website and online purchase interfaces; update, verification, and other device support services. These components together are referred to as the `Services`. Any B2B, or enterprise integrations are subject to separate legal terms.

1.3. Kraster provides a non-custodial, self-custody solution. We never store or access your private keys, recovery phrase, PIN, or any credentials tied to your digital assets. You alone are responsible for securing and managing your credentials. The Services are provided for personal and lawful use only, and subject to export controls and local laws. You are responsible for compliance with all applicable regulations.

1.4 You accept these Terms when you: • activate or set up a Kraster Device; • install or use the Kraster App; • place an order through the Kraster website; or • continue using the Services after updated Terms are published. If you do not accept these Terms, you must stop using the Services immediately.

1.5 These Terms operate alongside the following Kraster policies: Privacy Policy – how your personal data is processed; Website Terms of Use – governing public website use; Warranty, Refund, Shipping Policies – covering purchases and delivery. In the event of conflict, these Terms take precedence in matters involving the operation, security, or use of Kraster devices, firmware, or apps.

1.6. Kraster may update these Terms from time to time. The effective date and version number are indicated at the top. Your continued use of the Services constitutes acceptance of the revised Terms.

1.7. These Terms form an enforceable electronic agreement under Hong Kong SAR law. Kraster provides self-custody tools and does not act as a financial intermediary, custodian, broker, or asset manager. We do not store, hold, or manage digital assets on your behalf.

2. Definitions

For the purposes of these Terms, the following capitalized terms have the meanings set out below. Terms defined in the singular include the plural and vice versa. References to `including` mean `including, without limitation.`

Account means a user profile created within the Kraster App or on the Kraster website to manage device settings, purchases, or updates.

App or Kraster App means the official mobile and desktop applications used to interact with the Device, display balances, prepare transactions, and manage firmware updates.

Blockchain or Blockchain Network means any decentralized distributed ledger network supported by the Device or App, including Bitcoin, Ethereum.

Device or Kraster Device means the physical hardware wallet manufactured by Kraster for generating and storing cryptographic keys and signing blockchain transactions locally.

Firmware means the proprietary software embedded in the Device and digitally signed by Kraster that enables secure operations and communication with the App.

Private Key means a cryptographic key generated and stored only on the Device, used to authorize transactions. Kraster never has access to any Private Key.

Seed Phrase or Recovery Phrase means a series of words generated by the Device that allows Users to back up and restore their wallet. Kraster has no access to the Seed Phrase and cannot recover it if lost.

PIN means a personal code created by the User to secure access to the Device. Loss of the PIN may render the Device inaccessible without the Seed Phrase.

Transaction means any blockchain operation, including value transfer or message signing, initiated by the User and authorized via the Device. Transactions are irreversible once broadcast.

Fork means a protocol change in a blockchain network that results in two or more separate chains. Kraster may, but is not obligated to, support such chains.

Gas or Network Fee means a transaction fee charged by a blockchain network. Kraster does not set, receive, or control these fees.

Third-Party Services means external services accessible through the App (e.g., exchanges, NFT marketplaces, payment providers), each governed by its own terms. Kraster is not responsible for their performance or content.

Non-Custodial means that Kraster does not access, store, or control Users` private keys, recovery phrases, or digital assets. Users are solely responsible for managing their credentials and recovery data.

Services means the Device, Firmware, App, official website, online store, and all related infrastructure operated by Kraster.

Supported Networks or Supported Assets means blockchain networks and digital assets currently compatible with the Device and App. The list is available on the Kraster website and may be updated without notice.

Warranty Period means the time during which the Device is covered by Kraster`s limited hardware warranty, as described in the Warranty Policy.

User means any individual who owns, installs, or uses a Kraster Device or App, or accesses Kraster Services for personal use, and is at least 18 years of age (or legal age in their jurisdiction).

Website means the official Kraster website at https://krasterwallet.com, including all subdomains and e-commerce sections operated by Kraster.

3. Scope of Services & Architecture

3.1 Components of the Kraster ecosystem. The Services consist of the following core components: the Kraster Device, which performs all cryptographic operations locally; the Kraster App, which acts as a communication interface; the Firmware, embedded and digitally signed by Kraster; and the Website and online store, which provide informational, purchasing, and support access. Ancillary third-party services (such as payment processors or exchange integrations) may be available within the App but remain the sole responsibility of their respective providers.

3.2 Security model and control limitations. Kraster provides a non-custodial system. All key generation and signing occur within the Device. The App never stores or accesses private keys, PINs, or Seed Phrases. The Website and store do not interact with user wallets or cryptographic material. Users are fully responsible for: • keeping their Device physically secure, • managing backups of their Seed Phrase and PIN, and • protecting against unauthorized access.

3.3 Data Flow and Interoperability. The App communicates with the Device through an encrypted local connection. Transaction data is prepared in the App, signed on the Device, and returned to the App for broadcast. Kraster does not intercept or modify this flow. For blockchain data (balances, confirmations, gas), the App may connect to third-party node providers. These services are independent, and Kraster makes no guarantees as to their availability or accuracy.

3.4 Software and firmware updates. Kraster maintains a secure infrastructure for App and firmware updates. All updates are digitally signed and must be installed from official sources. Installing unauthorized software or failing to apply security updates may: compromise device integrity, void the warranty, and result in loss of functionality. Kraster may discontinue support for outdated software in line with its End-of-Life (EOL) policy.

3.5 Control over Blockchain Networks. Kraster does not operate or control any blockchain network, validator, or node infrastructure. We cannot: • reverse or cancel transactions, • influence gas fees, or • guarantee network performance or confirmation times. Blockchain operations depend on decentralized networks beyond Kraster`s control. The Services are provided `as is,` without warranty against protocol-level events (e.g., forks, delays, reorganizations).

3.6 Service availability and modifications. Kraster may modify or discontinue certain features of the Services for security, legal, or operational reasons. Temporary interruptions may occur due to maintenance, updates, or third-party service issues. Where legally required or operationally material, Kraster will notify Users via the App, Website, or registered email address.

3.7 Eligibility and intended use. The Services are intended for use by individuals: aged 18 or older (or legal age in their jurisdiction); and legally permitted to use digital asset tools in their country. Unless explicitly authorized by Kraster in writing, Services are for personal, non-commercial use only. Users are responsible for ensuring local legal, regulatory, and tax compliance.

4. User Responsibilities and Security Obligations

4.1 Key security and custody. You are solely responsible for the confidentiality and protection of your Kraster Device, Seed Phrase, PIN, and any credentials linked to your digital assets. Kraster does not store, access, or recover any private keys or Seed Phrases. Loss or compromise of these credentials will result in permanent loss of access to your assets. You must: • generate and store your Seed Phrase securely in an offline medium; • avoid storing or copying it in any digital or online format; • set a strong, confidential PIN and avoid reuse or disclosure; • apply firmware and software updates promptly from official sources; • avoid connecting the Device to untrusted systems or networks. Unauthorized modification, mishandling, or failure to secure the Device or credentials constitutes a material breach of these Terms and may void the warranty. This exclusion shall apply to the extent permitted by applicable consumer protection laws.

4.2 Transaction verification. Before approving any blockchain transaction, you must verify the transaction details on the Device screen. The App may provide a preview, but only the Device display is authoritative. Kraster is not liable for: • user mistakes, incorrect addresses, or fee selection; • malware, phishing, or man-in-the-middle attacks; • any losses resulting from unauthorized or mistaken approvals. Blockchain transactions are irreversible once signed and broadcast.

4.3 Physical handling. You must handle and store the Device in a secure, dry environment and protect it from: • unauthorized access or tampering; • physical damage, moisture, or extreme conditions; • any attempt to open, modify, or repair the Device. In case of suspected compromise, immediately transfer assets using your Seed Phrase and discontinue use of the affected Device.

4.4 Use of app and online interfaces. You are responsible for using the App and Website on secure, up-to-date systems. Always verify that the domain is krasterwallet.com and the connection is encrypted (valid SSL). Kraster is not responsible for any loss or breach resulting from: • use of counterfeit or phishing websites; • compromised user systems; • negligence in following basic cybersecurity practices.

4.5 User accounts. If you create an account via the App or Website (for purchases or updates), you must: • provide accurate and up-to-date contact information; • protect your login credentials; • notify Kraster of any suspected unauthorized access. You are responsible for all activity performed using your account.

4.6 Legal compliance and permitted Use. You may use the Services only in accordance with applicable laws, including export control, sanctions, and anti-money laundering regulations. You must not: use the Services for illegal purposes or infringe third-party rights; access the Services from jurisdictions where use is prohibited by law. Kraster may restrict or terminate access in the event of suspected unlawful use or risk to Service integrity.

4.7 Blockchain operations and fees. You are responsible for all blockchain-related costs, including gas fees and transaction charges. Kraster does not: set or control these fees; reimburse failed, delayed, or overpriced transactions; guarantee successful execution of blockchain operations. Ensure sufficient funds are available in your wallet before initiating any transaction.

5. Transactions and Blockchain Operations

5.1 All transactions initiated via the Device and App are executed directly on decentralized blockchain networks that operate independently of Kraster. Once signed and broadcast, transactions are final and irreversible. Kraster has no ability to cancel, modify, refund, or reverse any transaction. You are solely responsible for verifying all transaction details on the Device before approval.

5.2 The App prepares transaction data, but all cryptographic signing is performed exclusively by the Device. After you confirm a transaction on the Device screen, the signed transaction is returned to the App and submitted to the blockchain via third-party nodes. Kraster does not validate, store, or intercept transaction data and has no control over network confirmation or execution. Network delays or rejections due to congestion or fee levels are expected and outside Kraster`s control.

5.3 You must always verify the recipient address, amount, asset type, and network on the Device display before approving a transaction. The App may display previews, but the Device is the sole authoritative source. Kraster is not liable for: • incorrect addresses, clipboard interference, or user error; • malware, phishing attempts, or manipulated UI; • transactions signed or approved without proper user diligence.

5.4 All blockchain transactions require payment of network fees (`gas`) determined by the blockchain protocol. Any estimates shown in the App are non-binding and may differ from the actual fee charged. Kraster does not influence, receive, or refund such fees. You are solely responsible for ensuring that your wallet contains a sufficient balance to cover all applicable fees before initiating any transaction.

5.5 Blockchain networks are decentralized and not operated by Kraster. Accordingly, Kraster cannot guarantee: • timely inclusion of transactions; • continuous availability of the network; • protection from forks, reorganizations, or consensus failures; • the accuracy of blockchain data received from third-party nodes. Temporary inconsistencies or delays in transaction status or balance display do not indicate any defect in the Services.

5.6 A Fork or chain split occurs when a blockchain undergoes a protocol change resulting in multiple chains. Kraster may, at its discretion, support or decline to support any resulting chain or asset. You are responsible for: verifying asset compatibility with the Device or App; managing assets across chains after a fork or protocol update. Kraster is not liable for loss, duplication, or display errors resulting from forks, upgrades, or incompatible networks.

5.7 The App may use third-party node providers to display balances, confirmations, and network data. These providers are independent of Kraster, and we do not guarantee the accuracy, timeliness, or availability of such data. The blockchain itself remains the only authoritative record of asset ownership and transaction history.

5.8 If supported, interaction with smart contracts or DApps is performed at your sole discretion and risk. Kraster does not audit, validate, or endorse any external contracts, protocols, or services. We are not responsible for any losses resulting from: • defective or malicious smart contracts; • incorrect user input; • failures in gas estimation or transaction execution.

5.9 You acknowledge that blockchain networks may experience: bugs, exploits, validator failures, or consensus errors; double-spend attacks, 51% attacks, or chain halts. Kraster bears no responsibility for losses, discrepancies, or interruptions resulting from such events.

5.10 Kraster is not a custodian, broker, financial intermediary, or payment service provider. You are solely responsible for understanding and complying with local laws and tax obligations. Kraster does not monitor, report, or disclose your transactions to any third party unless legally compelled to do so under applicable law.

6. Software, Firmware Updates and Lifecycle

6.1 Official Software and Authenticity. The Device and App must be used only with official software and firmware developed and signed by Kraster. You must download Kraster software exclusively from krasterwallet.com or verified app stores. Installing or using modified, unofficial, or unsigned software constitutes a material breach of these Terms and voids any warranty or support. Kraster disclaims all liability for damages, data loss, or security issues caused by unauthorized software.

6.2 Firmware Verification. All official firmware is digitally signed by Kraster and verified on-device prior to installation. You must not install any firmware that fails signature verification or originates from unverified sources. Use of unsigned or tampered firmware may lead to irreversible asset loss and security compromise.

6.3 Updates and Security Maintenance. Kraster periodically releases updates to enhance security, functionality, and network compatibility. You are responsible for applying security-critical updates without delay. Failure to install required updates may expose the Device to vulnerabilities or break compatibility. Kraster is not liable for issues caused by outdated software, interrupted installations, or failure to update. You must back up your Seed Phrase before initiating any update and ensure a stable environment during installation.

6.4 Compatibility and End-of-Life (EOL). Kraster guarantees compatibility only with the most recent officially supported software versions and operating systems. At its sole discretion, Kraster may discontinue support for specific firmware versions, Devices, or OS platforms. EOL notices with applicable dates and affected models shall be published on the official Kraster website and may also be communicated via email. Users are responsible for maintaining an active email subscription or checking the official Website for such notices. After EOL, Kraster is not obligated to provide updates, patches, or maintenance. Use of unsupported versions is at your own risk.

6.5 Software Performance and Limitations. All software and firmware are provided `as is` and `as available`, without guarantees of uninterrupted operation, future features, or backward compatibility. Features may be modified or removed to comply with legal or security requirements. Kraster does not guarantee compatibility with external tools, even if previously supported. Performance may vary based on your operating system, device hardware, or network conditions.

6.6 User backup and data responsibility. Prior to any firmware or App update, you must back up your Seed Phrase and credentials. Kraster is not responsible for data loss, wallet resets, or configuration issues caused by updates or user actions. Kraster does not store or recover user data and cannot restore lost or corrupted wallets.

6.7 Modification or discontinuation of services. Kraster may change, suspend, or discontinue specific App or firmware features as needed for security, operational, or regulatory reasons. Where practical, Kraster will provide advance notice via the official website or in-app notification. Continued use of the Services after such changes constitutes acceptance of the revised functionalities and Terms.

7. Third-Party Services and Integrations

7.1 Kraster Services may include optional access to third-party tools and services, such as: • exchanges, fiat on-ramps or payment processors; • decentralized applications (DApps); • blockchain node providers and explorers; • NFT marketplaces and asset display tools. These integrations (Third-Party Services) are operated independently and are not controlled by Kraster. They are offered solely for user convenience and are neither developed nor endorsed by Kraster.

7.2 Each Third-Party Service is governed by its own terms of use and privacy policy, which you must review and accept separately. By interacting with any such service through the Kraster App, Device, or Website, you acknowledge that: • your relationship is exclusively with the third-party provider; • Kraster is not a party to any resulting agreement or transaction; • Kraster assumes no obligations, responsibility, or liability for such services.

7.3 Kraster does not recommend, endorse, or guarantee the legality, quality, or reliability of any Third-Party Service. Inclusion of a service, link, or API in the App or Website does not imply partnership or validation. Kraster makes no warranties regarding the accuracy, timeliness, or completeness of any information or functionality provided by such services.

7.4 Any pricing, exchange rates, or portfolio data presented within the Kraster App are for informational purposes only. Such data may be incomplete, delayed, or inaccurate due to reliance on external sources. Kraster disclaims all liability for decisions based on this content and urges users to verify information independently before acting.

7.5 If you initiate a transaction (e.g., swap, fiat purchase) through a Third-Party Service: • the transaction is processed directly by the third-party provider, not Kraster; • Kraster does not act as broker, custodian, intermediary, or agent; • Kraster cannot cancel, refund, or reverse any third-party operation; • you are solely responsible for validating the legitimacy and trustworthiness of any third-party website, app, or smart contract before use.

7.6 Engagement with external services involves inherent risks, including: • interaction with malicious or faulty smart contracts; • phishing, spoofing, or fake interfaces; • financial loss due to counterparty failure, insolvency, or code exploits; • data exposure or privacy breaches. Kraster has no control over these risks and disclaims all liability for any resulting losses, errors, or disputes.You are fully responsible for applying appropriate due diligence and security measures.

7.7 Some integrations may operate via decentralized protocols without a central authority. Such services may lack support, refund processes, or regulatory oversight. Kraster does not audit or verify any smart contracts and cannot guarantee their safety or compatibility. You use them at your own risk.

7.8 Kraster may add, suspend, or remove access to any Third-Party Service at any time, for any reason, including: legal or regulatory requirements; user safety; operational or technical limitations. Kraster bears no responsibility for any loss, disruption, or inconvenience caused by such changes. Your continued use of the Services constitutes acceptance of any updated integration scope.

7.9 By using Third-Party Services accessible via Kraster, you acknowledge and agree that: • all such interactions are voluntary and at your sole risk; • Kraster does not validate, supervise, or assume liability for external tools; • you release Kraster from any claim, loss, or dispute related to such services.

7.10 At launch, Kraster integrates with ChangeHero for asset swaps via secure API. Kraster does not transmit private keys, wallet credentials, or seed data to exchange partners. Future integrations (e.g., ChangeNow, Changelly) may be added under similar privacy-preserving, non-custodial conditions. Kraster is not responsible for any KYC or identity checks required by integrated Third-Party Services. All integrations remain subject to the terms and conditions of the respective third-party provider and may be changed or removed without prior notice.

8. E-Commerce

8.1 This section governs all purchases of Kraster Devices and accessories made via the official website (https://krasterwallet.com) or through authorized resellers. By placing an order, you enter into a legally binding sale agreement with Kraster Technology Solutions Limited (`Kraster`, `we`, `us`, `our`), subject to these Terms and applicable policies (including, if applicable, Refunds, Returns, Warranty, and Shipping).

8.2 Product Information and Availability. Product descriptions and specifications are for informational purposes and may be updated or improved without prior notice. Availability is not guaranteed. In case of unavailability post-purchase, Kraster will offer a refund or a comparable replacement.

8.3 Order placement and acceptance. An order constitutes an offer to purchase. A binding contract is formed only upon Kraster`s confirmation via email or other digital means. Kraster reserves the right to reject or cancel orders at its discretion, including for fraud prevention, export compliance, or stock errors.

8.4 Pricing, currency, and taxes. Prices are displayed in the selected currency and may include or exclude taxes as indicated during checkout. Final pricing, including duties and shipping fees, is confirmed before payment. You are solely responsible for any customs, import duties, or bank fees in your jurisdiction. In the event of pricing errors, Kraster may cancel the order and issue a refund before shipment.

8.5 Payments and processors. Accepted payment methods include credit/debit cards, wire transfers, digital wallets, and crypto payments, processed by approved third-party providers. Kraster does not process or store full payment data and disclaims liability for delays or reversals caused by such providers. Cryptocurrency payments are final and non-refundable once confirmed on-chain, unless otherwise required by law or Kraster`s Refunds Policy.

8.6 Shipping and delivery Kraster ships globally via recognized logistics providers. Current partners may include DHL and others, as updated on the Website. Estimated delivery times are non-binding and subject to customs or carrier delays. Risk transfers to you upon delivery to the carrier, unless otherwise required by law. You are responsible for providing accurate delivery details and receiving the shipment. Kraster is not liable for lost or delayed shipments due to incorrect addresses or failure to collect.

8.7 Withdrawal and cancellation rights If you reside in the EEA or similar jurisdictions, you may withdraw from the purchase within 14 days of delivery, without giving a reason. To exercise this right, you must notify Kraster in writing and return the product unopened and unused. Opened Devices cannot be returned due to security concerns, unless defective under warranty. Refunds are issued after inspection of the returned item, using the original payment method. Return shipping is at your expense unless otherwise stated by law or Kraster policy.

8.8 Returns and refunds Returns are accepted only for purchases made via the official Website and in accordance with the Refunds and Returns Policy. Returned items must be unopened, unused, and in original packaging. Kraster may deduct reasonable fees or shipping costs from refunds, where permitted. Refunds are processed via the original payment method unless agreed otherwise.

8.9 Defects and damaged goods. If a Device arrives damaged or defective, you must notify Kraster within 7 days of delivery. Upon verification, Kraster will repair, replace, or refund the item in accordance with the Warranty Policy. Kraster may request proof of purchase and photo evidence of the issue before authorizing a return. Damage caused by misuse, modification, or unauthorized repair is not covered.

8.10 Customs and local regulations. International orders may be subject to inspection, delays, and additional charges imposed by customs authorities. You are responsible for such charges and for ensuring that the Device is legally importable and usable in your country. Kraster is not liable for customs-related delays, rejections, or regulatory restrictions.

8.11 Risk and ownership transfer. Ownership of the Device transfers upon full payment. Risk of loss or damage transfers upon delivery to the carrier or the User, depending on applicable law. You should inspect the shipment upon delivery and report any visible damage to the carrier and Kraster without delay.

8.12 Resale and authorized distributors. Kraster Devices are sold for personal use only. Commercial resale without prior written consent is prohibited. Official sales are conducted via the Kraster Website and verified accounts on marketplaces such as Amazon, eBay, and AliExpress. Purchases from unauthorized sellers are not covered by Kraster`s warranty or support. Kraster accepts responsibility only for products sold via its official channels or authorized distributors.

8.13 Fraud and export controls. Kraster may cancel or block orders suspected of fraud, sanctions violations, or export control breaches.You agree to provide accurate information and respond to reasonable verification requests. Kraster may refuse shipment to restricted countries, regions, or sanctioned individuals or entities.

9. Limited Hardware Warranty

9.1 Kraster warrants that each new Kraster Hardware Device (Device) is free from defects in materials and workmanship under normal intended use for the following periods from the date of delivery to the original purchaser (Warranty Period): • 24 months for purchases within the European Economic Area (EEA); • 12 months for purchases in all other regions. This warranty applies only to the original purchaser and is non-transferable.

9.2 The warranty covers manufacturing defects only and does not extend to: • misuse, accidents, or improper handling; • installation of unauthorized firmware or software; • modifications, tampering, or non‑authorized repairs; • damage from moisture, fire, or extreme conditions; • normal wear, cosmetic imperfections, or packaging; • loss of private keys, Seed Phrase, PIN, or assets; • use with incompatible hardware or software; • purchases from unauthorized sellers or marketplaces. Kraster is not liable for indirect or consequential losses, including any loss of digital assets or data.

9.3 If a Device fails within the Warranty Period and under normal use, Kraster will, at its discretion: • repair the Device using new or refurbished parts; • replace it with a new or equivalent model; or • refund the original purchase price upon proof of purchase. Replacement Devices are warranted for the remainder of the original Warranty Period or 90 days, whichever is longer.

9.4 To initiate a claim, Users must: • contact Kraster Support via the official Website to obtain a Return Merchandise Authorization; • provide proof of purchase, the Device serial number, and a description of the issue; • follow diagnostic or packaging instructions provided by Kraster. Unauthorized returns or incomplete documentation may result in rejection. If the Device is confirmed defective and covered under warranty, Kraster will arrange repair, replacement, or refund.

9.5 Users bear the cost of shipping the Device to the designated service center unless otherwise required by law. If the claim is validated, Kraster covers the cost of return shipment. Risk of loss during transit remains with the sender until Kraster receives the Device. Kraster recommends using traceable, insured shipping methods.

9.6 If the returned Device is found not to qualify for warranty coverage, Kraster may offer a paid repair or replacement service. The User will be notified and may choose to proceed or have the Device returned at their expense.

9.7 This limited warranty is exclusive and replaces all other express or implied warranties, including merchantability or fitness for a particular purpose. Kraster does not guarantee uninterrupted or error‑free operation of the Device. The remedies in this Section are the User`s sole and exclusive remedies. Kraster`s total liability under this warranty shall not exceed the original purchase price of the Device.

9.8 This limited warranty grants specific legal rights. Users may also have additional statutory rights under local consumer protection laws that cannot be excluded. In the event of conflict between this warranty and mandatory consumer law, the latter prevails.

10. Intellectual Property and Licensing

10.1 All intellectual property rights in and to the Services, including the Kraster Device, firmware, software, App, website, documentation, logos, trademarks, and visual identity - are and shall remain the exclusive property of Kraster Technology Solutions Limited and its licensors. No ownership, title, or rights are transferred to the User under these Terms.

10.2 Kraster grants the User a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Kraster software solely for personal, lawful, and non-commercial purposes. This license applies only in connection with genuine Kraster Devices and in accordance with these Terms. The User may not: • copy, modify, distribute, or create derivative works of the software; • reverse-engineer, decompile, or attempt to extract source code, except where permitted by applicable law; • use the software with unauthorized hardware or third-party tools. All rights not expressly granted herein are reserved by Kraster.

10.3 Kraster software and firmware are protected by copyright and cryptographic verification mechanisms. The User must not: • install modified or unofficial firmware; • disable or bypass security features; • repurpose the software for any non-intended or commercial use. Any violation of this Section results in immediate license termination and voids all warranties and support.

10.4 `Kraster`, the Kraster logo, and all related product names and designs are trademarks or registered trademarks of Kraster. You may not use or reproduce Kraster trademarks without prior written consent. Unauthorized use may constitute trademark infringement under applicable law.

10.5 If you provide Kraster with feedback, suggestions, or ideas (Feedback), you grant Kraster a perpetual, royalty-free, and irrevocable license to use, adapt, and commercialize such Feedback without restriction. Kraster is under no obligation to implement or acknowledge submitted Feedback.

10.7 This license terminates automatically if the User: • violates these Terms; • uses the software for unlawful purposes; • installs unofficial firmware or tampers with the Device. Upon termination, the User must immediately cease all use and delete all copies of Kraster software. Kraster reserves the right to enforce its intellectual property rights through legal remedies, including injunctive relief.

10.8 The Services may display trademarks, content, or integrations belonging to third parties. All such intellectual property remains the property of its respective owners. Display of third-party content does not imply endorsement, affiliation, or license unless explicitly stated.

10.9 All provisions in this Section shall survive termination or expiration of these Terms, including those relating to ownership, license restrictions, and Feedback.

11. Risk Disclosure

11.1 Kraster provides non-custodial technology tools and is not a financial institution, broker, exchange, custodian, or payment service provider. Kraster does not offer financial, investment, legal, accounting, or tax advice. Any content displayed in the App, on the Website, or on the Device is for informational purposes only. Users are solely responsible for making their own decisions regarding digital assets and should consult independent professionals where appropriate.

11.2 All cryptographic keys are generated and stored locally on the Kraster Device. Kraster does not store, access, recover, or recreate any private keys, Seed Phrases, PINs, or digital assets. Users retain full control and responsibility over their credentials, backups, and asset management. Loss or compromise of such credentials may result in irreversible asset loss. Kraster has no ability to assist in recovery.

11.3 Blockchain transactions are final and irreversible once signed and broadcast. Digital assets are inherently volatile and high-risk. Their value may fluctuate significantly or drop to zero. Blockchain networks may undergo: • forks, reorganizations, or consensus failures; • bugs, attacks, or downtime; • delays in transaction inclusion or data propagation. The App may display outdated or incomplete blockchain data due to reliance on third-party nodes. Only the blockchain itself reflects the definitive state.

11.4 Kraster does not guarantee the availability, legality, or future support of any asset or blockchain network. Listing of an asset in the App or Device interface does not imply endorsement, legitimacy, or continued support. Kraster may add, modify, or remove supported networks or assets at its discretion, without liability for resulting losses.

11.5 Kraster does not provide regulated services such as securities trading, custodial accounts, fiat brokerage, or portfolio management. Users are solely responsible for compliance with all applicable laws, including: local tax obligations; digital asset regulations; AML/KYC requirements in their jurisdiction. Access to certain Services may be restricted based on regulatory or export control obligations. Third-party integrations (e.g., exchanges or fiat on-ramps) may require identity verification (KYC) under their own policies.

11.6 Kraster is not licensed as a Virtual Asset Service Provider (VASP) or equivalent entity under Hong Kong or international law. Nothing in these Terms shall be interpreted as establishing Kraster as a financial intermediary, fiduciary, or custodian. By using the Services, you acknowledge that you: • understand the technical and financial risks of self-custody; • assume full responsibility for your use of the Services and any asset losses; • release Kraster from liability for losses resulting from blockchain behavior, market conditions, or your decisions. • use the Services entirely at your own risk.

12. Disclaimers and Limitation of Liability

12.1 The Kraster Device, App, firmware, Website, and all related Services are provided `as is` and `as available`, without warranties of any kind - express, implied, statutory, or otherwise. To the maximum extent permitted by law, Kraster disclaims all implied warranties, including but not limited to: merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability. Kraster does not guarantee that: • the Services will meet your expectations or specific use cases; • any defects will be corrected; • software or firmware will be error-free or compatible with all devices or systems. The User acknowledges that use of Kraster`s Services inherently involves technological, operational, and blockchain-related risks.

12.2 Kraster is not responsible for errors, actions, or omissions made by Users, including: • incorrect transaction details; • mismanagement of credentials; • unsafe practices (e.g., phishing, malware exposure, social engineering). Users are solely responsible for verifying all information before approving transactions or interacting with external platforms.

12.3 Kraster shall not be liable for losses or disruptions resulting from: • blockchain network behavior, forks, reorgs, or congestion; • validator or miner failures; • outages of third-party nodes, APIs, or data providers; • internet, hosting, or infrastructure incidents beyond Kraster`s control.

12.4 To the fullest extent permitted by law: a) Kraster and its affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, goodwill, or digital assets. b) Kraster`s total aggregate liability for any claim shall not exceed the greater of: (i) USD 100; or (ii) the purchase price of the Device giving rise to the claim. c) These limitations apply regardless of the legal theory asserted and even if any limited remedy fails of its essential purpose.

12.5 The limitations of liability and disclaimers in this Section reflect a reasonable allocation of risk between the parties. You agree that this allocation is essential to Kraster`s ability to offer the Services on current terms and pricing.

12.6 Some jurisdictions do not allow certain exclusions or limitations of liability or warranties. In such cases, these Terms apply only to the maximum extent permitted by local law. Nothing in these Terms excludes or limits liability where such exclusion is prohibited by applicable consumer protection or product liability laws.

12.7 You agree to indemnify and hold harmless Kraster, its affiliates, employees, and agents from any claims, losses, or liabilities arising out of: your violation of these Terms; your unlawful use of the Services or Device; your infringement of third-party rights or legal obligations. Kraster reserves the right to assume the exclusive defense of any claim for which you provide indemnity and may require your cooperation in such defense.

12.8 All disclaimers, limitations of liability, and indemnification obligations shall survive termination or expiration of these Terms and remain enforceable with respect to past use of the Services.

13. Termination, Suspension, and Service Modifications

13.1 Kraster may, at its sole discretion and without prior notice, suspend, restrict, or terminate your access to any part of the Services (including the App, Website, or Device integrations) if: • you violate these Terms or any applicable law; • Kraster suspects fraudulent, abusive, or unauthorized activity; • Kraster must comply with legal obligations, court orders, or regulatory instructions; • continued access poses a security, operational, or legal risk; or • temporary suspension is required for maintenance, upgrades, or technical reasons, including scheduled maintenance, unplanned outages, or critical updates. Immediate suspension or termination may occur where necessary to prevent harm or liability.

13.2 You may stop using the Services at any time by: • uninstalling the App, • ceasing use of the Device, and • deleting related data from your systems. Termination does not release you from obligations accrued prior to the termination date (e.g., payment obligations). Kraster may retain certain minimal data for legal, audit, or compliance purposes, in accordance with its Privacy Policy.

13.3 Upon termination or suspension of Services: • your license to use the App, firmware, and related Services is immediately revoked; • access to third-party integrations may be disabled; • related user accounts (if any) may be deactivated; • no compensation or refund will be issued for loss of access. You remain solely responsible for all activity and liabilities incurred prior to termination.

13.4 Kraster may modify, upgrade, suspend, or discontinue any part of the Services at any time. Where feasible, Kraster will provide advance notice of material changes via the App, Website, or email. Kraster is not obligated to support or maintain legacy features or discontinued components. Users are responsible for maintaining backups and keeping software up to date to minimize disruption.

13.5 Kraster may restrict access to Services or functionality for specific users, countries, or regions in order to comply with: • export control regulations, • trade sanctions, or • other applicable legal requirements. This may include disabling certain updates or features. Kraster bears no liability for resulting inconvenience or limitations.

13.6 Termination or suspension does not affect the continued enforceability of provisions which, by their nature, survive termination. This includes (but is not limited to): Intellectual Property (Section 10); Risk Disclosure (Section 11); Disclaimers and Limitations (Section 12); Governing Law and Dispute Resolution (Section 14). All rights, remedies, and obligations that have accrued as of the termination date remain in effect.

14. Governing Law and Dispute Resolution

14.1 These Terms and any dispute, claim, or controversy arising out of or relating to them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (Hong Kong SAR), without regard to its conflict of law principles.

14.2 In the event of a dispute, both parties agree to first attempt resolution through good faith written negotiation. If the matter is not resolved within thirty (30) days of formal notice, either party may request mediation in accordance with the Hong Kong Mediation Council Rules. Participation in mediation is voluntary and does not limit either party`s right to proceed to arbitration if needed.

14.3 Any unresolved dispute shall be finally settled by binding arbitration under the HKIAC Administered Arbitration Rules in effect at the time. The seat of arbitration shall be Hong Kong SAR, and the language shall be English. The arbitration shall be conducted by a sole arbitrator, appointed in accordance with the HKIAC Rules. The arbitrator`s decision shall be final and binding, and enforceable in any jurisdiction with competent authority.

14.4 If you are a consumer residing in the European Economic Area (EEA) or a jurisdiction with mandatory consumer protection laws that provide local litigation rights, you may initiate proceedings in your local courts where such rights cannot be lawfully waived. This clause does not limit any statutory protections applicable to consumers.

14.5 To the fullest extent permitted by law, all disputes shall be resolved on an individual basis. You agree not to bring or participate in any class, collective, consolidated, or representative action.

14.6 Unless otherwise prohibited by applicable law, any claim arising from these Terms must be filed within one (1) year from the date the claim arises unless a longer period is required under mandatory consumer law. Claims not filed within this timeframe shall be permanently barred.

14.7 These Terms are drafted in English, which shall prevail in the event of any discrepancies between translations. Translated versions are provided for convenience only and shall have no legal force.

14.8 If any provision of these Terms is held to be invalid, unlawful, or unenforceable under applicable law, such provision shall be severed or modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Final Provisions

15.1 These Terms constitute the entire agreement between you and Kraster regarding your use of the Device, App, Website, and related Services, and supersede all prior understandings, agreements, or representations. No oral or written statements by any Kraster employee, distributor, or third party shall modify these Terms unless formally confirmed in writing by Kraster.

15.2 Kraster shall not be liable for delays or failures in performance due to causes beyond its reasonable control, including natural disasters, war, government actions, labor disputes, internet or power outages, pandemics, or blockchain network disruptions. Obligations shall be suspended during such events and resume once conditions allow.

15.3 Kraster may assign or transfer its rights and obligations under these Terms to any affiliate or successor as part of a merger, acquisition, or corporate restructuring. You may not assign or transfer your rights without prior written consent from Kraster. Any unauthorized assignment shall be void.

15.4 Failure by Kraster to enforce any right or provision shall not constitute a waiver unless explicitly stated in writing. No waiver shall be construed as a continuing waiver unless expressly stated.

15.5 If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent required to be valid, and the remainder shall remain in full force and effect.

15.6 Kraster may update these Terms from time to time to reflect legal, technical, or operational changes. Material changes will be announced via the Website, App, or email, with an effective date. Continued use after that date constitutes acceptance. If you disagree, you must discontinue use before the changes take effect.

15.8 These Terms do not create any partnership, agency, employment, fiduciary, or joint venture relationship. Both parties act independently and at arm`s length.

15.9 You represent that you are not located in or affiliated with any sanctioned jurisdiction as listed on the Kraster Website or upon request (e.g., Cuba, Iran, North Korea, Syria) or listed on any restricted party list (e.g., OFAC, EU, UN). You agree not to export, re-export, or use Kraster products in violation of export control or sanctions laws. Kraster may restrict access to Services in compliance with applicable laws. The Services are not intended for users under 18 or in jurisdictions where digital asset use is restricted or prohibited.
